Detroit Metro Areas Child Custody/Child Support Modification Lawyer

If your, or the other parent’s, or the child’s circumstances have been materially and substantially affected by job loss or illness, you can - no, you Better motion the court in Michigan to review your situation and modify the terms of your divorce judgment.  In general, if your financial condition has been significantly change by factors beyond your control, the court will probably approve a temporary change in child support and/or maintenance (post divorce support) payments, if you have the evidence which includes evidence of your making the requisite, good faith attempt to find employment.

The spouse who is moving must convey the change to the court and convince the court in Michigan that it is in the best interests of the children for modification.

We help families in Michigan , with the following types of modification:

Child Support Modification: If there is a significant change in your income — either for the parent receiving child support or for the parent making child support payments, the court in Michigan may find that a child support modification is warranted. Child support modification requests usually surface when there is an income loss or increase, such as when a parent suffers a job loss or cut hours or when a parent is promoted. However, child support modifications can also be pursued if there is a change in the current child custody arrangement.

Visitation Modification: Whether the custodial parent relocates or your current visitation plan is just not working, we can help you file a petition to modify visitation.

Child Custody Modification: If it is in the best interest of your child(ren), it is possible to petition for a modification of child custody.

Alimony Modification: Spousal support is limited to cover only the time period reasonably necessary for the receiving spouse to become financially self-sufficient.  As a result, requests to extend the time to receive alimony must be made within the period identified in the court order and must be supported by sound reasons. If the support is modifiable, and the spouse can demonstrate a significant change in circumstances (diminishing income and job loss for reasons outside of spouse control may well be sufficient), spouse may be able to get a modification.  See MCL 552.28; Staple v Staple, 241 Mich App 562, 568, 578; 616 NW2d 219 (2000).

Whatever the case, when you need help modifying an existing child support order, or need defense against a proposed change that would not be right for you or your child, you need the help of our Michigan child support attorney who can aggressively protect your rights regarding proper and adequate support for you and your child.
